Misdemeanors vs. Felonies in Georgia

Georgia’s laws designate crimes as either misdemeanors or felonies and assign sentences based on the nature and severity of the crime. Do not be fooled though, they are both equally as serious and can change the rest of your life for the worse if you do not act quickly and retain an effective criminal defense attorney!

Misdemeanors

A charge that is less serious than a felony but more serious than an infraction, can carry up to a year in county or local jail and may include probation, fines, restitution payments, community service, and other conditions. Common misdemeanors include traffic offense cases such as DUI, simple possession of marijuana, speeding, failure to maintain lane, reckless driving and all other motor vehicle crimes that are not felonies. These cases are heard in the Municipal Court or State Court where a judge resolves the case without need of a jury.

Felonies

The most serious of charges which can carry a sentence of one year to life in state prison. Common felonies include DUI fourth offense, vehicular homicide, murder, rape, drug trafficking, computer sex crimes, and felony assault. Felonies are heard in the Superior Court which for Cobb County is located at 70 Haynes Street in Marietta, Georgia.

Take Control of Your Defense

If you are arrested and offered a representation from the Public Defender's Office then you need to very quickly evaluate your options. Public Defenders are not all as bad as the rap that they get, they have all received a Juris Doctorate from an accredited law school and they have passed their state's respective bar examination so they are just as qualified as any other criminal defense attorney. The big difference is that they are often flooded with cases and they generally aren't as invested in their clients because they are assigned their cases, they don't do consultations and evaluate the case and the client before agreeing to represent them. The public defenders office is a great place for new attorneys to get experience and learn from making mistakes because generally the risk is lower. When you hire a criminal defense attorney from Cobb Criminal Defense you get everything that you pay for and more. We internalize our cases and fight for you as if it were us in the hot seat. We leave absolutely no stone unturned for our clients and realize that by doing so we not only live up to our client's expectations of us but also the standard of law that we believe in ourselves. If you are looking for a Marietta criminal defense attorney then you need to call us first at (770)627-3221 and have a free consultation.

FAQ

  • What should I do when dealing with the authorities?
    1. Be cooperative. Do not fight back or be belligerent — any type of resistance may get you into further trouble.
    2. Exercise your right to remain silent. Don’t tell the police anything except your name, age, and address.
    3. Don’t try to explain your side of  what happened. Once you have been Mirandized anything you say can be used against you.
    4. Politely state that you do not want to answer any questions until you have Greg Chancy, your Cobb Defense lawyer present.
  • What happens when I get arrested?

Generally the following events will occur in order:

    • Booking
    • Initial Appearance
    • Getting out of Jail
    • Preliminary Hearing
    • Arraignment
  • What is Booking?

Upon arrival at the jail, the arresting officer will take you to the booking area. Depending on the number of people waiting to be booked, you may be placed in a holding cell to wait your turn. The booking officer will enter your personal information into a computer system, take your fingerprints and mugshot photo. During this process, you should be notified if you are eligible for bail.

You will be allowed one phone call to a person of your choosing. This is often a family member or friend who in turn calls a bail bond company or lawyer on your behalf. Next, you will be put in a jail cell and remain there until you post bail or a judge orders you to be released. No matter who you call, you need them to call Cobb Criminal Defense to secure you a local attorney to assist with your case.

  • What is Initial Appearance?

The purpose of an initial appearance is to make sure you are aware of the charges against you and to determine whether bail should be set. If you were arrested without a warrant, you will be brought before a magistrate judge within 48 hours of your arrest.

  • How do I get out of jail?

There are generally four different ways to get out of jail following an arrest:

    1. You or someone on your behalf can post cash for the full amount of bond
    2. You seek the assistance of a bond bailsmen
    3. A judge releases you on your own recognizance
    4. You offer real estate as collateral At an initial appearance, your Cobb Criminal Defense Attorney will attempt to get you released on your own recognizance. If this fails, your Cobb Criminal Defense Lawyer will advocate for the lowest bail amount.
  • What is a Preliminary hearing?

If bail is not set or you are unable to make bail, a preliminary hearing will be scheduled days later. The purpose of this hearing is for the magistrate judge to hear from both the prosecution and defense, evaluate the evidence and decide if there is probable cause to believe a crime has been committed.  This is a key phase of the judicial process that you need your Cobb Criminal Defense Attorney at your side.

If probable cause is established and the case involves a misdemeanor, it will be forwarded to the appropriate court and a trial date is set. If the charge is a felony, the case will be forwarded to the district attorney for presentation to the grand jury.

  • What is Arraignment?

An arraignment is a formal hearing in which the judge reads the charges against you and asks you to plead guilty or not guilty to the charge. In the majority of cases, clients plead not guilty and the case moves towards a trial. Your Cobb Criminal Defense Lawyer will create a plan and advise you through this process at your side.

  • What is Plea Bargaining?

In the early stages of the trial process, your Cobb Criminal Defense Attorney will take the time to gather evidence to build a strong defense and negotiate with the prosecutor to see if the case can be settled without going to trial. These negotiations are referred to as plea bargaining which is an attempt to strike a deal that reduces your charges or lightens your sentence.

  • What happens if it goes to trial?

When a favorable plea deal isn’t possible, it becomes necessary to fight the charges in court. Cobb Criminal Defense Lawyers have extensive courtroom experience and will be intimately involved in your case from selecting the jury, raising objections to improper evidence and testimony, cross-examining prosecution’s witnesses, and presenting your defense in the most passionate manner possible. Your Cobb Criminal Defense Attorney will not stop fighting to win for you!
